Verklaring gegevensbescherming BELFOR

§ 1 Informatie over de verzameling van persoonsgegevens

(1) Hierna geven wij informatie over de verzameling van persoonsgegevens bij het gebruik van onze website. Persoonsgegevens zijn alle gegevens die op u persoonlijk betrekking hebben, bijv. naam, adres, e-mailadressen, gebruikersgedrag.

Onze toezichthouder voor gegevensbescherming kunt u bereiken via privacy@belfor.com of op ons postadres met de toevoeging "de toezichthouder voor gegevensbescherming".

(3) Bij uw contactopname met/schadeaangifte aan ons via e-mail of via een contactformulier worden de door u meegedeelde gegevens (uw e-mail-adres, evt. uw naam en uw telefoonnummer) door ons opgeslagen, om uw vragen te beantwoorden. De in dit verband verkregen gegevens wissen wij, nadat de opslag ervan niet meer nodig is of wij beperken de verwerking ervan, indien wettelijke opslagverplichtingen bestaan.

(4) Indien wij voor individuele functies van ons aanbod een beroep willen doen op aangestelde dienstverleners of indien wij uw gegevens voor reclamedoeleinden willen gebruiken, zullen wij u onderstaand gedetailleerd over de respectieve procedures informeren. Daarbij vermelden wij ook de vastgelegde criteria van de opslagtermijn.

§ 2 Uw rechten

(1) U heeft ten opzichte van ons volgende rechten wat betreft de persoonsgegevens die op u betrekking hebben:

  • recht op informatie,
  • recht op verbetering of verwijdering,
  • recht op beperking van de verwerking,
  • recht op bezwaar tegen de verwerking,
  • recht op gegevensoverdraagbaarheid.

(2) U heeft bovendien het recht om bij de toezichthoudende instantie voor gegevensbescherming een klacht in te dienen over de verwerking van uw persoonsgegevens door ons.

§ 3 Verzameling van persoonsgegevens bij bezoek van onze website

(1) Bij het louter informatieve gebruik van de website, dus wanneer u zich niet registreert of ons op een andere manier informatie verstrekt, verzamelen wij alleen de persoonsgegevens, die uw browser naar onze server verstuurt. Wanneer u onze website wilt bekijken, verzamelen wij de volgende gegevens die voor ons technisch nodig zijn, om u onze website te kunnen tonen en om de stabiliteit en veiligheid te garanderen (rechtsgrondslag is art. 6 alinea 1 pag. 1 sub. f AVG):

  • IP-adres
  • datum en tijd van de aanvraag
  • tijdzoneverschil met Greenwich Mean Time (GMT)
  • inhoud van de aanvraag (concrete pagina)
  • toegangsstatus/HTTP-statuscode
  • hoeveelheid gegevens die telkens worden verstuurd
  • website, waarvan de aanvraag afkomstig is
  • browser
  • bedrijfssysteem en zijn interface
  • taal en versie van de browsersoftware.

(2) Naast de eerder vermelde gegevens worden bij uw gebruik van onze website cookies op uw computer opgeslagen.  Cookies zijn kleine tekstbestanden, die op uw harde schijf gekoppeld aan de browser die u gebruikt, worden opgeslagen en waardoor bepaalde informatie stroomt naar de plaats die het cookie inneemt (hier door ons). Cookies kunnen geen programma's uitvoeren of virussen op uw computer overdragen. Ze dienen om het internetaanbod globaal gebruiksvriendelijker en doeltreffender te maken.

(3) Gebruik van cookies:
a) Deze website gebruikt volgende soorten cookies, waarvan de omvang en werking hierna worden verklaard:

  • tijdelijke cookies (zie b)
  • permanente cookies (zie c).

b) Tijdelijke cookies worden geautomatiseerd verwijderd, wanneer u de browser sluit. Daartoe horen vooral de sessie-cookies. Die slagen een zogenaamde sessie-ID op, waarmee verschillende aanvragen van uw browser aan de gezamenlijke sessie kunnen worden toegekend. Daardoor kan uw computer worden herkend, wanneer u terugkeert naar onze website. De sessie-cookies worden verwijderd, wanneer u uitlogt of de browser sluit.
c) Permanente cookies worden geautomatiseerd na een vastgestelde tijd verwijderd, die voor elke cookie kan verschillen. U kunt de cookies in de beveiligingsinstellingen van uw browser op elk moment verwijderen.
d) U kunt uw browserinstelling volgens uw wensen configureren en bijv. de aanvaarding van cookies van derden of van alle cookies weigeren. Wij wijzen u erop dat u eventueel niet alle functies van deze website kunt gebruiken.
e) Wij gebruiken cookies om u voor volgende bezoeken te kunnen identificeren, indien u een account hebt bij ons. Anders zou u voor elk bezoek opnieuw moeten inloggen.
f) De gebruikte flash-cookies worden niet door uw browser geregistreerd, maar door uw flash-plug-in. Verder gebruiken wij HTML5 storage objects, die op uw eindapparaat worden opgeslagen. Deze objecten slaan de nodige gegevens, onafhankelijk van de browser die u gebruikt, op en hebben geen automatische vervaldatum. Wanneer u niet wenst dat de flash-cookies worden verwerkt, moet u de juiste add-on installeren, bijv. "Better Privacy" voor Mozilla Firefox (https://addons.mozilla.org/de/firefox/addon/betterprivacy/) of het Adobe-Flash-Killer-cookie voor Google Chrome. Het gebruik van HTML5 storage objects kunt u verhinderen, door in uw browser de privémodus in te stellen. Daarnaast raden wij aan om regelmatig uw cookies en de browsergeschiedenis handmatig te verwijderen.

§ 4 Meer functies en aanbiedingen van onze website

(1) Naast het louter informatieve gebruik van onze website bieden wij verschillende diensten aan, die u in geval van interesse kunt gebruiken. Daartoe dient u doorgaans verdere persoonsgegevens te vermelden, die wij gebruiken om de dienst in kwestie te leveren en waarvoor de eerder genoemde principes voor gegevensverwerking gelden.

(2) Voor de verwerking van uw gegevens doen wij gedeeltelijk een beroep op externe dienstverleners. Die zijn zorgvuldig door ons geselecteerd en aangesteld. Zij zijn gebonden aan onze instructies en zij worden regelmatig gecontroleerd.

(3) Verder kunnen wij uw persoonsgegevens aan derden doorgeven, wanneer deelnames aan acties, kansspelen, sluiten van overeenkomsten of gelijkaardige diensten door ons samen met partners worden aangeboden. Verdere informatie hierover ontvangt u bij de opgave van uw persoonsgegevens of onderstaand in de beschrijving van het aanbod.

(4) Zover de zetel van onze dienstverleners of partners gevestigd is in een staat buiten de Europese Economische Ruimte (EER), informeren wij u over de gevolgen van deze situatie in de beschrijving van het aanbod.

§ 5 Nieuwsbrief

(1) Met uw toestemming kunt u zich abonneren op onze nieuwsbrief, waarmee wij u op de hoogte houden van onze actuele interessante aanbiedingen. De gekochte goederen en diensten worden benoemd in de toestemmingsverklaring.

(2) Voor de aanmelding voor onze nieuwsbrief gebruiken wij de zgn. double-opt-in-procedure. Dit betekent dat wij u na uw aanmelding een e-mail sturen op het vermelde e-mailadres waarin wij u vragen om te bevestigen dat u de verzending van de nieuwsbrief wenst. Wanneer u uw aanmelding niet binnen 24 uur bevestigt, worden uw gegevens geblokkeerd en na een maand automatisch verwijderd. Bovendien slaan wij telkens uw gebruikte IP-adressen en tijdstippen van de aanmelding en bevestiging op. Doel van de procedure is om uw aanmelding te bewijzen en evt. een mogelijk misbruik van uw persoonsgegevens te kunnen verklaren.

(3) Verplichte opgave voor de verzending van de nieuwsbrief is alleen uw e-mailadres. De opgave van andere, apart gemarkeerde gegevens is vrijwillig en wordt gebruikt om u persoonlijk te kunnen aanspreken. Na uw bevestiging slaan wij uw e-mailadres op met als doel de toezending van de nieuwsbrief. Rechtsgrondslag is art. 6 alinea 1 pag. 1 sub. a AVG.

(4) U kunt op elk moment uw toestemming voor de verzending van de nieuwsbrief herroepen en de nieuwsbrief opzeggen. De herroeping kunt u toelichten door te klikken op de link die in elke nieuwsbrief-e-mail aanwezig is, via e-mail aan [Newsletter@belfor.com] of door een bericht aan de in het impressum vermelde contactgegevens.

§ 6 Bezwaar tegen of herroeping van de verwerking van uw gegevens

(1) Wanneer u toestemming heeft gegeven voor de verwerking van uw gegevens, kunt u die op elk moment herroepen. Een dergelijke herroeping beïnvloedt de betrouwbaarheid van de verwerking van uw persoonsgegevens, nadat u de herroeping aan ons hebt kenbaar gemaakt.

(2) Voor zover wij de verwerking van uw persoonsgegevens op de belangenafweging baseren, kunt u bezwaar tegen de verwerking indienen. Dit is het geval wanneer de verwerking vooral niet voor de naleving van een overeenkomst met u nodig is, wat door ons telkens bij de hiernavolgende beschrijving van de functies wordt weergegeven. Bij uitoefening van een dergelijk bezwaar vragen wij u om een toelichting van de redenen, waarom wij uw persoonsgegevens niet zoals door ons is gebeurd, mogen verwerken. In geval uw bezwaar gegrond is, controleren wij de situatie en zullen ofwel de gegevensverwerking instellen resp. aanpassen of u onze dwingende "gewettigde" redenen aantonen, op basis waarvan wij de verwerking verderzetten.

(3) Uiteraard kunt u de verwerking van uw persoonsgegevens voor reclamedoeleinden en gegevensanalyse op elk moment weigeren. Over uw bezwaar tegen reclame kunt u ons op volgende contactgegevens informeren:

§ 7 Web Analytics

Gebruik van Google Analytics

(1) Deze website gebruikt Google Analytics, een webanalysedienst van Google Inc. ("Google"). Google Analytics gebruikt zgn. "cookies", tekstbestanden, die op uw computer worden opgeslagen en die een analyse van uw gebruik van de website mogelijk maken. De door het cookie verzamelde informatie over uw gebruik van deze website wordt doorgaans naar een server van Google in de VSA verstuurd en daar opgeslagen. In geval van activering van de IP-anonimisering op deze website, wordt uw IP-adres van Google echter in deze lidstaten van de Europese Unie of in andere verdragsluitende staten van het akkoord over de Europese Economische Ruimte op voorhand afgekort. Alleen in uitzonderlijke gevallen wordt het volledige IP-adres naar een server van Google in de VSA verstuurd en daar afgekort. In opdracht van de exploitant van deze website zal Google deze informatie gebruiken om uw gebruik van de website te evalueren, om rapporten over de website-activiteiten samen te stellen en om verdere diensten verbonden met het gebruik van de website en het gebruik van het internet tegenover de website-exploitant te verstrekken.

(2) Het in het kader van Google Analytics door uw browser verstuurde IP-adres wordt niet samengevoegd met andere gegevens van Google.

(3) U kunt de opslag van cookies door een correcte instelling van uw browsersoftware verhinderen; wij wijzen u er echter op dat u in dit geval eventueel niet alle functies van deze website optimaal kunt gebruiken. U kunt bovendien de registratie van de gegevens gecreëerd door het cookie en met betrekking tot uw gebruik van de website (incl. van uw IP-adres) aan Google en de verwerking van deze gegevens door Google verhinderen, door de browser-plug-in in de volgende link te downloaden en installeren: http://tools.google.com/dlpage/gaoptout?hl=de.

(4) Deze website gebruikt Google Analytics met de extensie „_anonymizeIp()“. Daardoor worden IP-adressen afgekort verder verwerkt, zodat kan worden uitgesloten dat die aan een persoon kunnen worden gekoppeld. Voor zover de via u verzamelde gegevens aan een persoon kunnen worden gekoppeld, wordt die dus onmiddellijk uitgesloten waardoor de persoonsgegevens onmiddellijk worden verwijderd.

(5) Wij gebruiken Google Analytics om het gebruik van onze website te kunnen analyseren en regelmatig te kunnen verbeteren. Via de verkregen statistieken kunnen wij ons aanbod verbeteren en voor u als gebruiker interessanter vormgeven. Voor de uitzonderingen waarin persoonsgegevens naar de VSA worden verstuurd, heeft Google zich aan het EU-US Privacy Shield onderworpen, https://www.privacyshield.gov/EU-US-Framework. Rechtsgrondslag voor het gebruik van Google Analytics is art. 6 alinea 1 pag. 1 sub. f AVG.

(7) Deze website gebruikt Google Analytics bovendien voor een analyse van bezoekersstromen op verschillende apparaten, die via een user-ID wordt uitgevoerd. U kunt in uw klantenaccount onder "Mijn gegevens", "persoonsgegevens" de analyse van uw gebruik op verschillende apparaten deactiveren.

§ 8 Social Media

Gebruik van social-media-plug-ins

(1) Wij gebruiken momenteel volgende social-media-plug-ins: [Facebook, Google+, Twitter, Instagram, YouTube]. Wij gebruiken daarbij de zgn. twee-klik-oplossing. Dit wil zeggen dat wanneer u onze pagina bezoekt, eerst in principe geen persoonsgegevens aan de aanbieders van de plug-ins worden doorgegeven. U herkent de aanbieders van de plug-ins door de markering op het vakje door zijn initialen of het logo. Wij bieden u de mogelijkheid om via de knop direct met de aanbieder van de plug-in te communiceren. Alleen wanneer u op het gemarkeerde veld klikt en het daardoor activeert, ontvangt de plug-in-aanbieder de informatie dat u de bijbehorende website van ons online aanbod hebt geopend. Daarnaast worden de gegevens vermeld onder § 3 van deze verklaring verstuurd. Bij Facebook wordt na opgave van de aanbieder in kwestie in Duitsland het IP-adres onmiddellijk na de verzameling geanonimiseerd. Door de activering van de plug-in worden dus persoonsgegevens van u naar de plug-in-aanbieder in kwestie verstuurd en daar (bij Amerikaanse aanbieders uit de VS in de VSA) opgeslagen. Omdat de plug-in-aanbieder de gegevensverzameling vooral via cookies uitvoert, raden wij u aan om voordat u op het grijze vakje boven de beveiligingsinstellingen van uw browser klikt, alle cookies te verwijderen.

(2) Wij hebben geen invloed op de verzamelde gegevens en gegevensverwerkingsprocessen, noch kennen wij de volle omvang van de gegevensverzameling, de doelen van de verwerking, de opslagtermijnen. Ook over het verwijderen van de verzamelde gegevens door de plug-in-aanbieder hebben wij geen informatie.

(3) De plug-in-aanbieder slaat de over u verzamelde gegevens als gebruikersprofielen op en gebruikt deze voor reclamedoeleinden, marktonderzoek en/of nodige vormgeving van zijn website. Een dergelijke beoordeling gebeurt vooral (ook voor niet ingelogde gebruikers) voor de weergave van nodige reclame en om andere gebruikers van het sociale netwerk over uw activiteiten op onze website te informeren. U heeft het recht om bezwaar in te dienen tegen de creatie van deze gebruikersprofielen, waarbij u zich om dit te doen gelden tot de plug-in-aanbieder in kwestie dient te richten. Via de plug-ins bieden wij u de mogelijkheid om met de sociale netwerken en andere gebruikers te interageren, zodat wij ons aanbod kunnen verbeteren en voor u als gebruiker interessanter kunnen uitwerken. (4) De gegevensoverdracht gebeurt onafhankelijk van het feit of u een account bij de plug-in-aanbieder heeft en daar ben ingelogd. Wanneer u bij de plug-in-aanbieder bent ingelogd, worden uw gegevens die bij ons zijn verzameld direct aan uw account die bij de plug-in-aanbieder bestaat, gekoppeld. Wanneer u de geactiveerde knop gebruikt en bijv. de pagina linkt, slaat de plug-in-aanbieder ook deze informatie in uw gebruikersaccount op en deelt die aan uw contacten publiek mee. Wij raden u aan om na gebruik van een sociaal netwerk regelmatig uit te loggen, vooral echter voor activering van de knop, omdat u zo een toewijzing aan uw profiel bij de plug-in-aanbieder kunt vermijden.

(5) Andere informatie over doel en omvang van de gegevensverzameling en de verwerking door de plug-in-aanbieder ontvangt u in de volgende meegedeelde privacyverklaringen van deze aanbieders. USE AND SHARING OF INFORMATION

BELFOR uses strong, 128-bit encryption and SSL, short for Secure Sockets Layer, a protocol for transmitting private information via the Internet. SSL uses a private key to encrypt data that is transferred over the SSL connection. This protocol is a standard used by many websites when you submit confidential information, such as credit card numbers and other personal data. SSL creates a secure connection between your browser and our server. Addresses of web pages using an SSL connection start with https: instead of http: and most browsers also display an icon of a closed padlock. BELFOR applications and our site are when you visit a page using SSL.
